Trademark Registration

Trademark Registration

How much does trademark registration cost? A Hong Kong trademark is $3,200 for one mark in one class, $1,800 for each additional class, valid for 10 years.

A trademark is the legal protection for your brand: once it is registered you have the exclusive right, and nobody else can use the same or a similar sign to sell the same kind of goods or services. The search, choosing the classes, filing and following up with the Intellectual Property Department: we do it all in one go. The Intellectual Property Department takes about 6–8 months to examine the application and issue the certificate. We can also handle trademarks in mainland China, Taiwan, Japan, the United States, the European Union and elsewhere.

The trademark registration process

  1. Before you apply: confirm the type of mark you want to register (word, device, combined word and device, three-dimensional, and so on).
  2. Choose the classes: pick the matching classes from the international classification list, based on the goods or services you sell.
  3. Similarity search and risk assessment: we compare your mark against existing registered trademarks to reduce the risk of refusal or infringement.
  4. Send us the applicant's details: the registration details of the person or company, the registered address, and so on.
  5. Send us the mark itself: the device or the wording; a device or combined mark needs a clear image file.
  6. Draw up the list of goods and services: set out what the application covers, matching the classes chosen.
  7. We file the documents and pay the fees to the Intellectual Property Department.
  8. The Intellectual Property Department takes about 6–8 months to examine the application and issue the certificate.

Trademark registration FAQ

What can be a trademark?
Any sign that can be represented graphically and perceived visually: words (including names and letters), numerals, designs, combinations of colours, or any combination of these. A three-dimensional shape also counts, as long as it can be recorded and published as a drawing or a written description.
How do I improve the chance of registration?
Go for an original sign, one with something new about it.
Avoid wording that directly describes the nature, the quality or the geographical origin of the product.
Use a coined word with no particular meaning, or a combination that has nothing to do with the product; the more distinctive it is, the lower the risk of refusal.
Run a similarity search before you apply. We compare your mark against existing registered trademarks.
How long does trademark registration take?
We need about 1 month to prepare and file; the Intellectual Property Department takes about 6–8 months to examine the application and issue the certificate.
How much are the government fees?
The Intellectual Property Department charges HK$2,000 for one class and HK$1,000 for each additional class; registration lasts 10 years and can be renewed any number of times (source: Intellectual Property Department). Our $3,200 is the fee for one mark in one class.
If I have registered a company name, do I automatically have trademark protection?
No. A company name is registered with the Companies Registry and a trademark with the Intellectual Property Department; they are two separate systems. To protect a brand name or a logo, you have to apply for a trademark separately.
How do I choose the classes?
The international classification list divides trademarks into 45 classes, and you choose by the goods or services you actually sell. If you sell more than one kind of product, you need more than one class, at $1,800 for each additional class. If you are not sure, tell us what you sell and we will pick for you.
Can you handle mainland China or overseas trademarks at the same time?
Yes. We can handle trademarks in mainland China, Taiwan, Macau, Japan, South Korea, the United States, Canada, the United Kingdom, France, Germany and the European Union. The fee is quoted separately for each place.
